INJURY, ASSUMPTION OF RISK AND LIABILITY RELEASE WAIVER

IMPORTANT: This waiver affects your legal rights. Please read it before signing.

This Waiver applies to participation in activities provided, organized, hosted, or supervised by Absolute Brazilian Jiu-Jitsu Inc., operating as Absolute Brazilian Jiu-Jitsu / Absolute BJJ Academy (“Absolute BJJ”).

These activities may include Brazilian Jiu-Jitsu, Judo, grappling, martial arts, physical conditioning, classes, private lessons, open mats, seminars, clinics, camps, competitions, demonstrations, special events, and related activities (“Activities”).


1. ACKNOWLEDGEMENT OF ACTIVITIES AND RISKS

I understand that Brazilian Jiu-Jitsu, Judo, grappling, martial arts, and related Activities involve close physical contact and strenuous physical activity.

Participation may include, but is not limited to:

  • grappling and ground fighting;

  • takedowns and throws;

  • breakfalls and falling;

  • joint locks and submission techniques;

  • choke and strangle techniques;

  • positional control and physical pressure;

  • drilling techniques with training partners;

  • live sparring or rolling;

  • physical conditioning;

  • accidental impacts, falls, or collisions; and

  • contact with other participants, instructors, mats, floors, walls, equipment, or other objects.

I understand that participation involves inherent and foreseeable risks of injury, even when reasonable instruction, supervision, rules, and safety precautions are provided.

Possible injuries include, but are not limited to:

  • bruises, cuts, abrasions, and mat burns;

  • muscle strains and sprains;

  • ligament and tendon injuries;

  • joint injuries;

  • dislocations;

  • fractures;

  • dental and facial injuries;

  • eye injuries;

  • concussions and other head injuries;

  • neck and spinal injuries;

  • loss of consciousness;

  • neurological injuries;

  • temporary or permanent disability; and

  • in rare circumstances, catastrophic injury or death.

I understand that not every possible risk or injury can be anticipated or listed in this Waiver.


2. VOLUNTARY ASSUMPTION OF RISK

I understand the nature of the Activities and voluntarily choose to participate, or where applicable permit the minor participant identified in this Waiver to participate.

I knowingly and voluntarily accept the inherent and foreseeable risks associated with participation in the Activities.

I understand that injuries may occur as a result of:

  • my own actions or decisions;

  • the actions or decisions of another participant;

  • differences in participant size, strength, age, experience, or ability;

  • accidental or unintended contact;

  • execution or attempted execution of techniques;

  • falls, throws, takedowns, submissions, or sparring;

  • equipment or training-surface conditions;

  • fatigue or physical exertion; or

  • other circumstances inherent in martial arts participation.

I understand that compliance with safety procedures can reduce risk but cannot eliminate all risk of injury.


3. PARTICIPANT RESPONSIBILITIES

I agree that I, or the minor participant where applicable, will:

  • follow the reasonable instructions of Absolute BJJ instructors and staff;

  • comply with applicable Academy safety rules and policies;

  • train in a controlled manner appropriate to the circumstances;

  • respect the safety and physical limitations of training partners;

  • immediately stop applying a submission when a training partner submits or an instructor directs the technique to stop;

  • submit or “tap” when necessary to protect my own safety;

  • notify an instructor of an injury, illness, restriction, or safety concern that may affect participation;

  • stop participating if I become unable to continue safely;

  • use required clothing and protective equipment where applicable;

  • remove jewellery or other objects that may create an unreasonable safety risk; and

  • not participate while impaired by alcohol, recreational drugs, or another substance that makes participation unsafe.

I understand that Absolute BJJ may restrict, modify, suspend, or discontinue my participation where an instructor reasonably believes continued participation presents a safety risk.


4. HEALTH AND MEDICAL RESPONSIBILITY

I am responsible for considering whether I am physically capable of participating safely in the Activities.

Where I am signing for a minor participant, I am responsible for considering whether the minor is physically capable of participating safely.

I agree to provide Absolute BJJ with information reasonably necessary for safe participation, including relevant:

  • injuries;

  • physical restrictions;

  • allergies;

  • medical restrictions;

  • disabilities or accommodation requirements; or

  • other circumstances that may materially affect safe participation.

I understand that Absolute BJJ instructors and staff are not acting as physicians or other medical professionals and do not provide medical diagnosis or medical clearance.

Where I have concerns about my ability, or the minor participant's ability, to safely participate, I understand that appropriate advice from a qualified health-care professional should be obtained.


5. INJURY AND EMERGENCY RESPONSE

If an injury or medical emergency occurs during participation, I authorize Absolute BJJ instructors and staff to take reasonable immediate action appropriate to the circumstances, including:

  • stopping participation;

  • providing first aid within the responder's level of training;

  • contacting the participant's emergency contact;

  • contacting emergency medical services; and

  • providing emergency responders with information reasonably necessary to assist the participant.

Where I am signing for a minor participant, I authorize Absolute BJJ to contact emergency medical services where reasonably necessary, including where a parent or guardian cannot immediately be reached.

I understand that this authorization does not require an Absolute BJJ instructor or staff member to provide medical care beyond that person's training or qualifications.


6. ADULT PARTICIPANT RELEASE AND WAIVER OF LIABILITY

THIS SECTION APPLIES ONLY TO PARTICIPANTS WHO ARE 19 YEARS OF AGE OR OLDER.

In consideration of being permitted to participate in the Activities, I voluntarily accept and assume the risks associated with participation.

To the fullest extent permitted by applicable law, I hereby release and discharge:

Absolute Brazilian Jiu-Jitsu Inc.; Absolute Brazilian Jiu-Jitsu / Absolute BJJ Academy; and their respective owners, directors, officers, instructors, coaches, employees, volunteers, agents, representatives, affiliates, successors, and assigns

collectively referred to as the “Released Parties,”

from claims, demands, actions, causes of action, damages, losses, costs, or liabilities arising from or related to personal injury, illness, death, or property damage resulting from my participation in the Activities.

This release expressly includes claims arising from the ordinary negligence of a Released Party, including a failure to take reasonable care, to the extent that such liability may lawfully be released or excluded.

I understand that by accepting this section I am giving up certain legal rights that I might otherwise have against the Released Parties.

This Release does not release or limit any liability, right, remedy, benefit, or statutory protection that cannot lawfully be released, waived, excluded, or limited.


7. MINOR PARTICIPANT - PARENT/GUARDIAN CONSENT AND ACKNOWLEDGEMENT OF RISK

THIS SECTION APPLIES TO PARTICIPANTS UNDER 19 YEARS OF AGE.

I confirm that I am the participant's parent, legal guardian, or another person legally authorized to provide the required consent for participation.

I have read and understand the risks described in this Waiver.

I understand that Brazilian Jiu-Jitsu, Judo, grappling, and related martial arts Activities involve inherent risks of injury and that injuries may occur despite reasonable instruction, supervision, and safety precautions.

I voluntarily consent to the minor participant's participation in the Activities.

I agree to instruct the minor participant to:

  • follow instructor directions;

  • comply with Academy safety requirements;

  • respect training partners;

  • communicate injuries or safety concerns;

  • stop when directed by an instructor; and

  • otherwise participate in a safe and appropriate manner.

I understand that Absolute BJJ may restrict or discontinue the minor participant's participation where an instructor reasonably believes continued participation presents a safety risk.

Nothing in this Waiver is intended to waive, release, restrict, or eliminate a legal right belonging to a minor where that right cannot lawfully be waived or released by a parent or guardian.


8. NO GUARANTEE OF SAFETY

I understand that Absolute BJJ will take reasonable measures to provide instruction and operate its Activities safely.

I also understand that martial arts inherently involve physical contact and that no instructor, safety procedure, facility, equipment, or supervision can eliminate every possibility of injury.

No representation or guarantee has been made that participation will be free from injury.

9. COMPLIANCE WITH LAW

Nothing in this Waiver is intended to waive, release, restrict, or limit any right, protection, remedy, or liability that cannot lawfully be waived, released, restricted, or limited.

If any provision of this Waiver is determined to be invalid or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.

10. DURATION AND RENEWAL OF WAIVER

This Waiver applies to the participant's Activities with Absolute BJJ from the date it is accepted and will remain on file until it is replaced or updated.

Absolute BJJ may require a new Waiver where:

  • this Waiver is materially changed;

  • applicable law or insurance requirements change;

  • the nature of the Activities materially changes;

  • information relevant to the participant's consent materially changes; or

  • a participant who previously participated as a minor reaches 19 years of age.

A participant who reaches 19 years of age must personally complete any adult waiver required for continued participation.


11. ACKNOWLEDGEMENT AND ACCEPTANCE

By signing or electronically accepting this Waiver, I confirm that:

  • I have read this Waiver in its entirety;

  • I understand its contents;

  • I understand the nature of the Activities;

  • I understand that participation involves risks of injury, including serious injury;

  • I have had an opportunity to ask questions before accepting;

  • I voluntarily agree to the provisions applicable to me;

  • if I am an adult participant, I understand that the Adult Participant Release and Waiver of Liability affects my legal rights; and

  • if I am signing for a minor participant, I confirm that I am legally authorized to provide consent to that participant's participation.
