We love sharing photos and videos that showcase our students, classes and the Absolute BJJ community. From time to time, photos or videos taken during classes and events may be used on our website, social media or promotional materials. We do not sell student images and will not identify your child by full name without separate permission. You may change your preference at any time. Please review our policy below.
Absolute Brazilian Jiu-Jitsu Inc. (“Absolute BJJ”), located at 80 Bishop Drive, Fredericton, New Brunswick, may occasionally take photographs, video recordings, or other visual media during classes, seminars, camps, clinics, competitions, demonstrations, special events, and other Academy activities. Participation at Absolute BJJ does not require consent to promotional photography, video recording, social media use, or other promotional media use. Consent is optional. During registration, booking, or membership setup, the participant or their parent/legal guardian will be asked to select one of the following: YES - FULL PHOTO & VIDEO PERMISSION Absolute BJJ may photograph or record the participant and may use authorized photos or videos in accordance with this consent. GROUP PHOTOS & VIDEOS ONLY The participant may appear in class, team, event, or other group photos and videos, but Absolute BJJ will not intentionally feature, identify, or promote the participant individually. NO - NO PHOTO OR VIDEO PERMISSION Absolute BJJ will not intentionally photograph, record, or use identifiable photos or videos of the participant for promotional or public-facing purposes. If no valid consent choice is recorded, Absolute BJJ will treat the participant as having selected NO - NO PHOTO OR VIDEO PERMISSION until an express choice is obtained. 1. Consent The consent option selected during registration, booking, or membership setup determines the extent to which Absolute BJJ may intentionally collect, use, and disclose photographs, video recordings, or other media containing the participant. Authorized media may include: • photographs; • video recordings; • audio captured as part of a video recording; and • the participant's image or likeness. Consent applies only within the scope of the option selected. Consent to photography, video recording, or promotional media use is not a condition of membership, enrolment, booking, attendance, or participation at Absolute BJJ. 2. Full Photo & Video Permission Where YES - FULL PHOTO & VIDEO PERMISSION is selected, Absolute BJJ may intentionally photograph or record the participant and may use authorized media for reasonable Academy purposes, including: • Absolute BJJ's website; • Absolute BJJ-controlled social media accounts; • Facebook, Instagram, YouTube, TikTok, and similar platforms; • digital advertising; • printed advertising and promotional materials; • newsletters and Academy communications; • promotion of classes, programs, seminars, clinics, camps, competitions, demonstrations, and events; • recognition of participant achievements; • instructional or educational content; and • internal instructor or staff training. Absolute BJJ may reasonably crop, resize, edit, caption, or format authorized media for these purposes, provided the media is not used in a misleading, defamatory, or materially misrepresentative manner. 3. Group Photos & Videos Only Where GROUP PHOTOS & VIDEOS ONLY is selected, Absolute BJJ may include the participant in photographs or videos depicting a class, team, seminar, competition, event, or other group activity. Under this option, Absolute BJJ will not intentionally: • take or select an individual portrait of the participant for promotional use; • make the participant the primary or featured subject of promotional content; • crop or edit group media for the purpose of individually featuring the participant; • identify or tag the participant by name on social media or other promotional materials; or • use the participant individually in an advertisement, testimonial, profile, or promotional feature. The participant may nevertheless be identifiable as one member of a class, team, audience, event, or other group. Absolute BJJ will make reasonable efforts to ensure that media used under this option remains consistent with the participant's Group Photos & Videos Only preference. 4. Names and Identifying Information Where YES - FULL PHOTO & VIDEO PERMISSION is selected, Absolute BJJ may associate limited identifying information with authorized media where reasonably appropriate, including: • the participant's first name; • belt rank; • competition result; • promotion or award; or • other Academy achievement. Absolute BJJ will not publish a minor participant's full name in association with promotional media without additional permission where doing so is not reasonably necessary. Where GROUP PHOTOS & VIDEOS ONLY is selected, Absolute BJJ will not intentionally identify the participant by name in connection with the media. Media consent does not authorize Absolute BJJ to publish private or sensitive information such as: • home address; • personal telephone number or email address; • date of birth; • medical or health information; • school information; or • other private circumstances unrelated to the authorized purpose. Absolute BJJ will exercise additional care when publishing information concerning minors and will avoid unnecessarily disclosing information about a child's location, routine, contact information, or other private circumstances. 5. Public Social Media and Internet Use Where media is authorized for publication, the participant or parent/legal guardian acknowledges that photographs or videos published online may: • be viewed by members of the public; • be shared, copied, downloaded, or captured by screenshot; • be indexed by search engines; • remain available through third parties after the original content is removed; and • be processed by social media platforms according to their own terms, privacy policies, and practices. Absolute BJJ cannot control independent copying, redistribution, storage, or use by third parties after authorized media has been lawfully published. 6. No Compensation The participant or parent/legal guardian understands that no payment, royalty, or other compensation will be provided for authorized use of photographs, video recordings, or other media unless otherwise agreed in writing. 7. Declining Consent Where NO - NO PHOTO OR VIDEO PERMISSION is selected, Absolute BJJ will not intentionally photograph, record, publish, or use identifiable photographs or videos of the participant for promotional or public-facing purposes. Selecting NO will not affect the participant's ability to: • attend classes; • book or participate in a trial; • attend a seminar, clinic, camp, competition, demonstration, or event; • purchase or maintain a membership; or • otherwise participate in Absolute BJJ activities. Absolute BJJ will make reasonable efforts to prevent participants who have declined consent from being intentionally featured in Academy-created promotional photography or video. This does not mean that Absolute BJJ can guarantee that a participant will never appear incidentally in the background of another person's photograph or recording. Photography or recording independently undertaken by other participants, parents, guardians, spectators, competition organizers, media organizations, venue operators, or members of the public may be outside Absolute BJJ's control. Absolute BJJ's consent process does not grant third parties permission to collect, use, or publish another participant's personal information. 8. Changing or Withdrawing Consent The participant or parent/legal guardian may change or withdraw their media-consent preference at any time for future collection, use, and disclosure by contacting: info@absolutebjj.ca A participant may change from: • Full Permission to Group Only; • Full Permission to No Permission; • Group Only to Full Permission; • Group Only to No Permission; or • No Permission to either Group Only or Full Permission. Upon receiving a request, Absolute BJJ will update the participant's recorded media-consent status and apply the new preference to future photography, recording, use, and disclosure. Where consent is withdrawn or restricted, Absolute BJJ will discontinue future use that is inconsistent with the participant's updated preference. Where reasonably practicable, Absolute BJJ will also remove existing identifiable media from websites and social media accounts directly controlled by Absolute BJJ when the participant no longer consents to that use. Absolute BJJ may not be able to retrieve or remove: • printed materials already produced or distributed; • content already viewed, downloaded, or copied; • screenshots or copies created by third parties; • content independently reposted or retained by third parties; or • material outside Absolute BJJ's possession or control. A change or withdrawal of consent applies prospectively and does not make uses that occurred in accordance with valid consent before the change retroactively unauthorized. 9. Minor Participants Where a participant is not capable of providing meaningful consent on their own behalf, consent must be provided by a parent, legal guardian, or another person legally authorized to provide consent for that participant. Absolute BJJ will take particular care when collecting, using, or disclosing photographs, video recordings, or other personal information concerning children and youth. Where appropriate, Absolute BJJ may also take the wishes and maturity of an older child or youth into consideration even where consent has been provided by a parent or guardian. 10. Privacy Photographs, video recordings, audio recordings, and other media in which an individual can be identified may constitute personal information. Absolute BJJ will collect, use, disclose, retain, and safeguard such information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable, and Absolute BJJ's privacy practices. Absolute BJJ will limit its collection, use, and disclosure of participant media to purposes that have been identified and for which appropriate consent has been obtained. Consent to promotional photography, video recording, social media publication, or other promotional media use is optional and is not a condition of receiving martial arts services from Absolute BJJ. Participants and their authorized representatives may contact Absolute BJJ regarding their personal information, media-consent status, correction of their consent preference, withdrawal of consent, or other privacy-related questions.
